Terms and Conditions

These terms and conditions define the rights, obligations, and responsibilities between BENO TECHNOLOGIES FZ L.L.C. (hereinafter referred to as “BENOsim”) and its service users. These terms comply with the European Union’s e-commerce directives and the General Data Protection Regulation (GDPR). By agreeing to these terms, users may utilize BENOsim’s services.

1. Scope of Application

These terms apply to all prepaid eSIM services provided by BENOsim. The terms can be accessed at any time on the BENOsim website or app. BENOsim may only modify or waive certain provisions of these terms if explicitly agreed in writing with the customer.

2. Service Description

BENOsim eSIM Service

BENOsim provides prepaid eSIM services for global data communication.

Customers may purchase and register eSIMs through the BENOsim website or app.

All payments are processed through PayPal, Stripe, or other reliable, certified payment systems.

Registration Procedure for BENOSIM Services

To use the BENOsim service, customers must accept the general terms and conditions.

Customers provide the following information via the BENOsim web browser, either directly or through a service provider (such as a hotel, travel agency, etc.): first name, last name, billing address, and email address.

Device Compatibility

Customers are responsible for ensuring that their devices support eSIM and are unlocked for network use. BENOsim provides device compatibility information, but the list may change, and the latest devices may not always be included.

Customers are responsible for verifying device compatibility before proceeding with the purchase and are accountable for the accuracy of the information provided.

3. Commencement, Duration, and Termination of the Agreement

The agreement begins once the customer purchases and completes payment for the eSIM.

The agreement remains valid as long as the eSIM is active and services are provided. The agreement can be terminated at any time at the customer’s request.

BENOsim may immediately terminate the agreement in the following cases:

  • The customer violates the terms and conditions.
  • Fraudulent or abusive usage of the service is detected.
  • Legal requirements necessitate the termination of the agreement.

4. Customer Obligations

Customers agree to the following:

  • To use the services in compliance with applicable laws and refrain from illegal or abusive use of the eSIM provided by BENOsim.
  • To respect the intellectual property rights of others and avoid any infringement.
  • To refrain from using inappropriate language, threats, or harassment when interacting with BENOsim’s customer support team.
  • To not transfer or lend account information, including login credentials, to third parties.

5. Data Usage and Prevention of Fraudulent Use

Normal Usage Limits

BENOsim’s eSIM services are provided within the normal data usage limits. Some telecom providers may apply Fair Usage Policy data limits, and customers may experience speed restrictions when exceeding a certain threshold.

These limitations are determined by the local telecom provider, and may be applied without prior notice.

Fraudulent Use

The following behaviors are considered fraudulent use, and BENOsim reserves the right to take necessary action:

  • Excessive and abnormal data usage.
  • Exploiting system vulnerabilities or errors for fraudulent purposes.
  • Engaging in any behavior that disrupts the normal operation of the network.

Traffic Limitation and Speed Control

When a customer exceeds the data limit according to the Fair Usage Policy, the telecom provider may apply speed limitations without prior notice.

In cases of confirmed fraudulent use, BENOsim may impose additional traffic restrictions or terminate services, and in such cases, customers are not entitled to refunds or compensation.

6.Fees and Payment

Payment Terms

BENOsim services can be paid for using credit cards, debit cards, PayPal, Stripe, and other supported payment systems. The primary payment currency is USD ($); however, other currencies may be accepted depending on availability and supported payment methods. The transaction currency will be determined at the time of purchase.

All payments are secured through reliable and certified payment systems. By using these payment methods, Customers agree to abide by their respective terms and conditions. BENOsim processes payments in accordance with the terms and conditions of the payment providers.

Customers do not have the right to offset or dispute BENOsim charges unless the claim is legally valid.

Coupon Policy

BENOsim offers a free Coupon, which can be applied according to the set amount in various currencies and used in specific promotions.

BENOsim offers various coupons, including:

  • 1-Day Flat Rate Coupon
  • Percentage-Based Discount Coupons

which can be applied according to the set amount in various currencies and used in specific promotions.

Conditions for Using the 1-Day Flat Rate Coupon:

  • The coupon can be used on roaming and local network products sold by BENOsim, with only one coupon allowed per product.
  • The coupon cannot be combined with other discount offers.
  • Generally, the coupon is only applicable when purchasing products for 2 days or more, and only the amount equivalent to 1 day will be discounted.
  • In certain promotions, the 1-Day Flat Rate Coupon can be used to purchase 1-day products for free.
  • The coupon can be used only once per country, and it can be applied separately to roaming and local network products within the same country.

Conditions for Using Percentage-Based Discount Coupons:

  • Percentage-based coupons discount a specific percentage of the purchase amount.
  • Usage conditions and discount percentages will be specified for each coupon and may include a minimum purchase amount.
  • Only one coupon can be applied per product, and percentage-based coupons cannot be combined with other discount offers.
  • The coupon cannot be used in conjunction with other coupons or promotional offers.
  • The coupon is valid only within its specified validity period.
  • Coupon Handling in Case of Canceled Payments:

If a payment cancellation is approved, the used coupon will be reinstated and can be used again within the validity period.

Coupon Validity:

  • Each coupon has a specified validity period and can only be used within that period.
  • Expired coupons are automatically removed from the coupon list, and expired coupons cannot be reused or extended.

Coupon Abuse Prevention:

If coupon abuse is detected, BENOsim may take the following actions:

  • If misuse is confirmed, coupon usage may be restricted, or the user’s account may be temporarily suspended.
  • In severe cases of misuse, the account may be permanently banned, and the coupon will be voided.

Coupon abuse includes, but is not limited to, the repeated use of the same coupon across multiple accounts, exploiting system errors for fraudulent coupon usage, and similar actions.

7. Liability and Warranty

BENOsim is not liable for any damages caused by service interruptions or network issues.

The network service is managed by the local telecom provider, and BENOsim cannot guarantee continuous network availability.

8. Refund and Cancellation Policy

Right of Withdrawal (Digital Services)

Due to the nature of digital services, once an eSIM has been delivered, activated, or its QR code has been issued, the service is considered fully performed or partially consumed, and the customer expressly waives the right of withdrawal, in accordance with Article 16(m) of the EU Consumer Rights Directive.

Therefore, refunds are generally not available after the eSIM has been issued or activated.


Refund Eligibility

A refund may be granted only under the following limited circumstances:

  1. Non-Activated eSIM

    • The eSIM has not been activated, installed, or used.

    • No data usage has occurred.

    • The refund request is submitted within 14 days of purchase.

  2. Technical Failure Attributable to BENOsim

    • The eSIM cannot be activated or used due to a technical issue directly caused by BENOsim, and

    • BENOsim is unable to provide a replacement or resolve the issue within a reasonable time.

  3. Duplicate or Erroneous Charges

    • The customer has been charged more than once due to a system or payment error.


Non-Refundable Cases

Refunds will not be provided in the following cases:

  • The eSIM has been activated, installed, or partially used, regardless of data consumption.

  • The customer’s device is not compatible, locked, or unsupported.

  • Network issues, speed limitations, or coverage problems caused by local telecom providers.

  • Incorrect installation, user error, or failure to follow provided instructions.

  • Change of mind after purchase.

  • Fraudulent usage or violation of these Terms and Conditions.

  • Termination due to abusive, illegal, or suspicious activity.


Refund Method and Processing Time

  • Approved refunds will be issued only to the original payment method.

  • Refund processing may take 5–14 business days, depending on the payment provider.

  • Any transaction fees charged by payment processors may be deducted from the refunded amount, where permitted by law.


Chargebacks and Disputes

Customers are encouraged to contact BENOsim customer support before initiating a chargeback.

Unjustified chargebacks or payment disputes may result in:

  • Account suspension or termination

  • Permanent restriction from using BENOsim services


Coupon and Promotional Refunds

  • If a purchase made using a coupon is refunded, only the actual amount paid will be refunded.

  • Coupons used for refunded purchases will be reinstated only if the payment cancellation is approved and within the coupon’s validity period.
